"Mary Ann’s maiden name has been recorded as ‘Milne’, and a ‘note’ indicates it might be ‘Rourke’. Her maiden name ‘Milne’ was on James death certificate, the informant was James’s second wife. The BDM records I have show her maiden name as ‘Rourke’. The records include their marriage, their children’s baptism’s and my g-grandmother Julia’s marriage [.....]. It would therefore seem reasonable to suggest a reversal i.e. her maiden name be changed to ‘Rourke’ and the note refer to ‘Milne’, (this could be important, as her parents have not been found and ‘Milne’ could be a clue for further research)."

"Wollongong Old Catholic Cemetery was located at the South Eastern end of Crown Street Wollongong until c.1970s when the site was converted to the "Andrew Lysaght Park". In December 1998, the Foreshore Plaza was opened on what was a part of the old Cemetery. According to the dates at NSW BDM, the earliest burials at the Cemetery were recorded in 1805 and burials continued until that of Ellen Lysaght in May 1914. Wayne Hill has contributed his images and researched data that he completed in June 2004. He says: "The State Government has introduced legislation in Parliament to allow a development to proceed on the old Roman Catholic Cemetery site, next to the Wollongong Entertainment Centre. The Wollongong Amendment Bill will effectively add the land to an area managed by the Wollongong Sports ground Trust. The Member for Wollongong, Colin Markham, says the land will be used to build piers for a new grandstand at WIN Stadium and to expand a restaurant in the entertainment centre. Mr Markham says it is unlikely any human remains will be disturbed. "Typescript extracted from 'Register of the Names of and other relevant information in respect of persons buried (in the) Old Roman Catholic Cemetery, Crown Street, Wollongong, CGS 8311 (Kingswood 8/2020)'. The volume includes details of burials from 1805 to 1914, in the Catholic Cemetery, and is a copy from four foolscap pages of names from the Official Register. It includes details concerning the name of person interred, abode, when buried, age, birthplace, profession and by whom burial ceremony was performed. Some headstones have survived but unfortunately many have been lost or did not exist." A memorial wall has been erected on the site which lists in brief the names and ages of those persons known to have been buried in the original cemetery. Ten surviving headstones have been mounted on the wall and the substantial Lysaght monument, which is seen in both old and modern views of the site above, has been re-erected in front of the wall. She arrived in Australia in 1828 aboard the Elizabeth 4. Her crime was stealing from a person.She was 20 years,tried 9th July 1827 Clare, a hat trimmer and servant described as being 5 ft 4 1/2 in tall much freckled and pock pitted dark hair grey to dark eyes. All of this information comes from ancestry and I contacted family and am satisfied with the information I have found. If as some history says she was born 1827 she would have been only ?? years when she was convicted of her crimes. It is unfortunate that the marriage banns do [not] have ages for Mary Ann or James of Dapto NSW marriage 1840. Other information can be found 1828 NSW Aus census. Aus and NZ find a grave index, Aus list of convicts 1788-1950,ireland selection of catholic parish baptisms 1742-1881, NSW Aus convict indents 1788-1842, NSW Aus Gaol description and entrance books 1818-1930."

Note:

Marion has understandably raised the question of the information shown for Mary Anne ROURKE. Her age at death being 27 years is the prime cause of the doubt. Her age is confirmed from two sources. The original source of this information is probably the same source and is probably from the early church record.

Her age at death calculates as Mary being born about 1827. This also means that she would then be only 13 years of age at the time of her marriage to James. Unusual, but could be right.

Mary ROURKE, the convict, was 20 years of age when she arrived in Australia in 1828. This would mean that she would have been 32 years of age at the time she married and 46 years old at the time of her death. Her age at marriage is more consistent with the age of James at the time of the marriage.

At this time, with the scant information that is available about Mary (and James), it is difficult to link Mary Rourke, the convict, with the Mary who married James. More work to be done and correspondence with Marion is continuing.
